In the case of O’Brien v United States, the Supreme Court ruled that burning a draft card as a form of protest was not protected by the First Amendment. Chief Justice Warren, normally a strong defender of civil liberties wrote: “We cannot accept the view that an apparently limitless variety of conduct can be labeled “speech” whenever the person engaging in the conduct intends thereby to express an idea.”
