In Escobedo v. Illinois, the Supreme Court held that under the Sixth Amendment criminal suspects have a right to counsel during in-custody interrogations. The case was decided a year after the court held in Gideon v. Wainwright that indigent criminal defendants had a right to be provided counsel at trial. Danny Escobedo was arrested and released on suspicion of murdering his brother-in-law, in Chicago. He was later rearrested and interrogated for 14½ hours, while repeatedly denied his request to speak with his attorney.
